These Terms & Conditions ("Terms") govern your access to and use of Pixel Arcade Studio (the "Service"), operated by SparkNgine (sole proprietorship) ("SparkNgine," "we," "us," or "our").
By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Important: Pixel Arcade Studio is intended for children under 13 only with involvement and consent from a parent or legal guardian.
1) Eligibility and Parental Responsibility
1.1 Parent/Guardian Required
A child may use the Service only under the supervision and control of a parent or legal guardian ("Parent"). The Parent is the account holder and is responsible for:
- Providing accurate account and child profile information
- Providing any required consents
- Managing the child's access and settings
- Monitoring what the child creates and publishes
1.2 Age Restrictions
If you are not authorized to consent on behalf of a child, you may not create an account for a child.
2) Account Registration and Security
2.1 Account Ownership
Parent accounts are owned and controlled by the Parent who registers the account.
2.2 Account Security
You are responsible for maintaining the confidentiality of login credentials and for all activity under your account. Notify us immediately at support@sparkngine.com if you suspect unauthorized access.
3) The Service
Pixel Arcade Studio is a web-based creative studio that helps children generate, modify, and publish playable browser games using guided templates and AI-assisted tools. We may add, remove, or modify features at any time.
4) Beta Service Disclaimer
The Service may be offered as a beta, preview, or early-access product. This means:
- Features may change, break, or be removed
- The Service may be unavailable at times
- Data (including drafts and projects) could be reset, migrated, or reformatted as the platform evolves
We will take reasonable steps to minimize disruption, but you acknowledge and accept these beta risks.
5) User Content and Licenses
5.1 Your Content
"User Content" includes content you or your child submit, create, upload, or generate using the Service, including game projects, prompts, code, titles, descriptions, configurations, and uploaded assets.
As between you and SparkNgine, you (the Parent) retain ownership of your User Content, subject to the licenses below.
5.2 License You Grant to SparkNgine
To operate the Service, you grant SparkNgine a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify (for technical formatting), display, and distribute your User Content solely as needed to:
- Provide and maintain the Service (saving, editing, publishing)
- Enforce safety and policy controls
- Troubleshoot, secure, and improve the Service
This license ends when your User Content is deleted from the Service, except that:
- Copies may remain in backups for a limited period
- We may retain limited records where required for legal compliance or legitimate security purposes
5.3 Publishing
If you choose to publish a game, you understand it may be accessible to others (for example, by link). You agree not to publish content that includes personal information about a child (including full names, addresses, phone numbers, school names, or precise location).
6) AI-Assisted Features
6.1 AI Output Is Not Guaranteed
AI-assisted outputs (including code and suggestions) may be inaccurate, incomplete, or behave unexpectedly. You are responsible for reviewing outputs, especially prior to publishing.
6.2 Safety Controls
We apply safety controls intended to reduce inappropriate outputs. No system is perfect; if you encounter a concerning output, contact support@sparkngine.com.
7) Acceptable Use
You agree you will not (and will not allow a child to):
- Use the Service for illegal, harmful, or abusive purposes
- Attempt to bypass safety filters or moderation systems
- Upload or publish content that is hateful, sexually explicit, exploitative, violent, or otherwise inappropriate for children
- Include personal information in published content
- Reverse engineer, scrape, probe, or interfere with the Service's security or integrity
- Distribute malware or harmful code through the Service
- Attempt unauthorized access to accounts, systems, or data
We may suspend or terminate access for violations.
8) Intellectual Property
8.1 Our IP
The Service, including its software, designs, templates, trademarks, and logos, is owned by SparkNgine or its licensors and is protected by intellectual property laws.
8.2 Limited License to You
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial family use, subject to these Terms.
9) Payments, Subscriptions, and Billing
9.1 Subscription Plans
Some features may require a paid subscription. Pricing, plan features, billing cadence, and taxes (if applicable) will be disclosed at checkout or within the Service.
9.2 Payment Processing
Payments are processed by third-party payment processors. We do not store full payment card numbers.
9.3 Renewals and Cancellation
Unless otherwise stated at checkout, subscriptions renew automatically until canceled. You can cancel according to instructions provided in your account settings or at checkout. Cancellation typically stops future renewals but does not retroactively refund a current billing period unless required by law or a posted refund policy.
9.4 Refunds
Refund eligibility (if any) will be described at checkout, within the Service, or in a posted refund policy. Unless required by law, fees are generally non-refundable once a billing period begins.
10) Termination
10.1 Termination by You
You may stop using the Service at any time. You may request account deletion by contacting support@sparkngine.com.
10.2 Termination by Us
We may suspend or terminate your access if:
- You violate these Terms
- Your use poses a security, safety, or legal risk
- We are required to do so by law or valid legal request
We may also discontinue the Service (in whole or in part) at any time.
11) Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
- WE DO NOT WARRANT THAT AI-GENERATED OUTPUTS WILL BE ACCURATE OR SAFE IN ALL CASES.
Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
12) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- SPARKNGINE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.
- SPARKNGINE'S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO SPARKNGINE FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR $100 IF YOU PAID NOTHING).
Some jurisdictions do not allow limitations of liability, so some limits may not apply to you.
13) Indemnification
You agree to indemnify and hold harmless SparkNgine from and against claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of:
- Your or your child's use of the Service
- Your User Content
- Your violation of these Terms
- Your violation of applicable laws or rights of others
14) Dispute Resolution and Governing Law
14.1 Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
14.2 Informal Resolution First
Before filing a claim, you agree to contact us at support@sparkngine.com and attempt to resolve the dispute informally.
14.3 Venue (Where Claims Must Be Brought)
Except where prohibited by law, you agree that:
- Any dispute or claim must be brought exclusively in the state courts located in Contra Costa County, California, or
- If federal jurisdiction exists, in the United States District Court for the Northern District of California,
and you consent to personal jurisdiction in those courts.
15) Changes to These Terms
We may update these Terms from time to time. We will update the "Last Updated" date and may provide additional notice (e.g., via email or in-product notice) for material changes. Continued use of the Service after changes become effective constitutes acceptance.
